Responsibilities:
Drafting Wills and Trusts: An estate planning attorney creates legally binding documents such as wills, revocable living trusts, and other estate planning instruments to ensure the client's wishes are carried out upon their death.
Providing Legal Advice: The attorney advises clients on various estate planning strategies, such as tax implications, asset protection, and the most appropriate structures (e.g., trusts, charitable donations) to meet their goals.
Establishing Powers of Attorney: The attorney helps clients set up documents that designate trusted individuals to manage their financial and healthcare decisions if they become incapacitated.
Probate Guidance: After a client's death, the estate planning attorney often assists with the probate process, guiding executors through the legal procedures of distributing assets and resolving debts.
Estate Tax Planning: The attorney works with clients to minimize estate taxes by using tools like trusts, lifetime gifts, and tax exemptions to preserve wealth for heirs.
Asset Protection: Estate planning attorneys provide strategies to protect clients' assets from creditors, lawsuits, or other risks, using methods like irrevocable trusts or strategic gifting.
Updating Estate Plans: As life circumstances change due to marriage, divorce, the birth of children, or changes in financial status' the attorney helps clients review and update their estate plans to ensure they remain current and effective.
Working hours: 8:00 AM - 5:00 PM
Skills:
Knowledge of Tax Law: A strong understanding of federal, state, and estate tax laws is crucial for advising clients on minimizing tax liabilities, structuring trusts effectively, and planning for wealth transfer.
Attention to Detail: Estate planning and trust documents require precision. An attorney must be able to carefully draft complex legal documents, ensuring there are no errors that could create legal issues or invalidate the plan.
Communication Skills: The ability to explain complex legal concepts in a clear, accessible manner is essential for helping clients understand their options and make informed decisions about their estates and trusts.
Problem-Solving and Analytical Thinking: Estate planning attorneys must be able to analyze a client's financial situation, family dynamics, and long-term goals to craft tailored, effective estate plans. They must also resolve issues that arise during the probate or trust administration process.
Client Relationship Management: Building trust and maintaining strong, long-term relationships with clients is important. Estate planning often involves sensitive discussions about family matters, wealth, and death, so attorneys must exhibit empathy, discretion, and the ability to navigate these conversations with care.
Qualifications:
Ability to practice law in the state of Minnesota.
1-2 year attorneys will be considered but 4-5+ year attorneys with a book of business are Ideal.
